The firm of Bastien FAVARD, attorney at the Aix-en-Provence Bar, advises and represents owners, buyers, sellers, co-owners, landlords and tenants in all property disputes, before the judicial court of Aix-en-Provence, the protection litigation judge, the enforcement judge and the Aix-en-Provence Court of Appeal.

The firm’s practice covers the amicable phase, which is often decisive in this field, as well as court-ordered expert proceedings and the trial on the merits.

Hidden defects and property sales

A buyer who discovers after the sale a defect that the seller had not disclosed (water infiltration, cracks, presence of asbestos or termites, non-compliant sewage system, absence of a building permit) may bring an action under the hidden defects warranty within two years of discovering the defect, in order to obtain a price reduction or the rescission of the sale, together with damages where the seller was aware of the defect.

The firm also acts against property surveyors, estate agents and notaries whose liability may be engaged, and assists sellers and buyers in the event of a refusal to complete a preliminary sale agreement, a dispute over the immobilisation indemnity or the enforcement of a penalty clause.

Co-ownership

The firm assists co-owners and co-owners’ associations in challenging general meeting resolutions, which must be brought within two months of notification of the minutes, in disputes relating to the allocation and recovery of service charges, works, common and private areas, and in claims against the managing agent (syndic).

Construction and ten-year guarantee

Defects affecting a building (cracks, water infiltration, leaking swimming pools or terraces, poor workmanship) engage the liability of builders under the completion guarantee, the two-year guarantee or the ten-year guarantee. The firm brings direct actions against the ten-year liability insurer, including where the contractor has ceased to exist, applies for the appointment of a court expert in summary proceedings and follows the expert’s operations through to compensation.

The firm also handles disputes arising from individual house construction contracts and building contracts, acting for the owner as well as for the contractor.

Neighbours, easements and boundaries

Abnormal neighbourhood disturbances (noise, odours, overlooking, plantations), rights of way, encroachments, boundary determinations, party walls and challenges to a neighbour’s building permit: these disputes, frequent in the Aix area, require a precise analysis of title deeds, the land registry and planning rules. The firm favours a negotiated solution wherever possible and otherwise brings the matter before the judicial court.

Residential and commercial leases

The firm assists landlords and tenants with unpaid rent and eviction proceedings, challenges to notices to quit for repossession or sale, service charge reconciliations and the return of security deposits, works and substandard housing. In commercial matters, it acts in lease renewals and rent reviews, lease termination and eviction compensation.

Tailored support, fixed fees

Every property dispute is the subject, from the first meeting, of an analysis of the documents (deed of sale, surveys, co-ownership regulations, minutes, expert reports) and a proposed strategy. Fees are set on a fixed basis, by written agreement, for each phase of the proceedings. The firm systematically checks whether your legal protection insurance can cover all or part of the costs.

The firm receives clients by appointment at 320 rue Emilien Gautier, Aix-en-Provence (Les Milles). Contact the firm on +33 6 76 26 76 08 or by email at favard.avocat@gmail.com.
